Damian specialises in the clearance, protection and management of trade marks. He is also a copyright and domain name specialist.  Damian joined A J Park in 1993 and has been a partner since 2001.

Many of Damian's clients are Fortune 500 corporations. Damian also acts for New Zealand companies and in particular larger corporates and exporters. Industries he is particularly experienced in include telecommunications, film, television, music, pharmaceuticals, computer and internet, automobile, transport and finance.

Damian's work covers all aspects of trade mark and related intellectual property law. He advises on commercialisation of intellectual property rights and the development, management and protection of intellectual property strategies. Damian has been involved in developing and implementing brand and domain name protection frameworks and acted in a number of domain name disputes involving high profile names. He was also a member of the InternetNZ committee that established the dispute resolution system for .nz domain names.

As a trade mark team leader in the Wellington office of A J Park, Damian acts and advises on:

  • filing and prosecuting local and international trade mark applications;
  • trade mark assignments and other ownership changes;
  • trade mark oppositions;
  • researching and compiling evidence on trade mark use;
  • enforcing trade mark rights;
  • brand creation and management strategies;
  • registering domain names and setting up management systems for domain name portfolios;
  • negotiating licensing and related contracts;
  • customs notices;
  • domain name disputes;
  • copyright issues.


Damian is an active member of INTA Committees.  Damian also presents client seminars and writes articles on trade marks, branding and domain names for a variety of publications.
 
Damian was one of Asialaw's leading Lawyers in Intellectual Property (2007) and is listed in the Legal Media Group publication 'Guide to the World's Leading Trade Mark Law Practitioners'. Damian recently presented on the changes proposed by the current Trade Marks (International Treaties and Enforcement) Amendment Bill at the Intellectual Property Society of Australia and New Zealand (IPSANZ) seminar.

Damian is a fellow of New Zealand Institute of Patent Attorneys, a member of the International Trade Mark Association (INTA), InternetNZ, the New Zealand Law Society, the Wellington District Law Society and the Institute of Directors. He is also a Notary Public.
