Raising the Bar: Australia passes patent reform bill into law

Article  \  20 Apr 2012

Most provisions in the Act come into effect in 12 months (15 April 2013).

An exception is the changes to the exemptions to patent infringement that came into effect immediately.  The Act adds a statutory infringement exemption for experimental use of patented inventions for research and experimental activities.  It also extends the patent infringement exemption for activities undertaken for the purpose of obtaining information required for regulatory approval of pharmaceutical products and methods to non-pharmaceutical products and methods.
